Relevant Legal Bases
Relevant Legal Bases under the GDPR: Below you will find an overview of the legal bases of the GDPR on which we process personal data. Please note that, in addition to the provisions of the GDPR, national data protection regulations in your or our country of residence or establishment may apply. Furthermore, if, in individual cases, more specific legal bases are relevant, we will inform you of these in the privacy policy.
- Consent (Art. 6 (1) (1) (a) GDPR) - The data subject has given consent to the processing of his or her personal data for one or more specific purposes.
- Performance of Contract and Pre-contractual Inquiries (Art. 6 (1) (1) (b) GDPR) - Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
- Legal Obligation (Art. 6 (1) (1) (c) GDPR) - Processing is necessary for compliance with a legal obligation to which the controller is subject.
- Legitimate Interests (Art. 6 (1) (1) (f) GDPR) - Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.
National Data Protection Regulations in Germany: In addition to the data protection regulations of the GDPR, national data protection regulations apply in Germany. This includes, in particular, the Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG), which contains special provisions on the right to information, the right to erasure, the right to object, the processing of special categories of personal data, processing for other purposes, and transfer and automated decision-making in individual cases, including profiling. Furthermore, the data protection laws of the individual federal states may apply.
Note on Applicability of GDPR and Swiss DPA: These data protection notices serve to provide information in accordance with both the Swiss Data Protection Act (DPA) and the General Data Protection Regulation (GDPR). For this reason, please note that due to the broader spatial application and comprehensibility, the terms of the GDPR are used. In particular, instead of the terms "processing" of "personal data," "overriding interest," and "sensitive personal data" used in the Swiss DPA, the terms "processing" of "personal data," as well as "legitimate interest" and "special categories of data" as used in the GDPR, are employed. However, the legal meaning of the terms will continue to be determined by the Swiss DPA within the scope of its applicability.
Security Measures
In accordance with legal requirements and taking into account the state of the art, implementation costs, and the nature, scope, context, and purposes of processing, as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, we implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk.
These measures include, in particular, safeguarding the confidentiality, integrity, and availability of data by controlling physical and electronic access to the data, as well as access, input, disclosure, ensuring availability, and their separation. Furthermore, we have established procedures that ensure the exercise of data subject rights, the erasure of data, and responses to data breaches. We also consider the protection of personal data during the development or selection of hardware, software, and procedures, in accordance with the principle of data protection by design and by default.
Transfer of Personal Data
In the course of our processing of personal data, it may occur that this data is transferred to or disclosed to other entities, companies, legally independent organizational units, or individuals. Recipients of this data may include, for example, service providers entrusted with IT tasks or providers of services and content embedded in a website. In such cases, we comply with legal requirements and, in particular, conclude corresponding contracts or agreements with the recipients of your data that serve to protect your data.
International Data Transfers
Data Processing in Third Countries: If we process data in a third country (i.e., outside the European Union (EU), the European Economic Area (EEA)) or if processing takes place within the framework of using third-party services or disclosing or transferring data to other persons, entities, or companies, this will only occur in compliance with legal requirements. If the data protection level in the third country has been recognized by an adequacy decision (Art. 45 GDPR), this serves as the basis for the data transfer. Otherwise, data transfers will only take place if the data protection level is otherwise secured, in particular through standard contractual clauses (Art. 46 (2) (c) GDPR), explicit consent, or in the case of contractual or legally required transmission (Art. 49 (1) GDPR). Furthermore, we will inform you about the bases of third-country transfers for individual third-country providers, whereby adequacy decisions shall take precedence as bases. EU-US Trans-Atlantic Data Privacy Framework: Within the framework of the so-called "Data Privacy Framework" (DPF), the EU Commission also recognized the data protection level as secure for certain companies from the USA in its adequacy decision of 10.07.2023. A list of certified companies, as well as further information on the DPF, can be found on the website of the US Department of Commerce at https://www.dataprivacyframework.gov/ (in English). We will inform you within the privacy policy which of the service providers we use are certified under the Data Privacy Framework.
Rights of Data Subjects
Rights of Data Subjects under the GDPR: As a data subject, you have various rights under the GDPR, which arise in particular from Art. 15 to 21 GDPR:
- Right to Object: You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Art. 6(1) GDPR, including profiling based on those provisions. Where personal data are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.
- Right to Withdraw Consent: You have the right to withdraw given consents at any time.
- Right of Access: You have the right to obtain confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and further information and a copy of the data in accordance with legal requirements.
- Right to Rectification: In accordance with legal requirements, you have the right to obtain the completion of incomplete data concerning you or the rectification of inaccurate data concerning you.
- Right to Erasure and Restriction of Processing: In accordance with legal requirements, you have the right to obtain the erasure of personal data concerning you without undue delay, or alternatively, in accordance with legal requirements, to obtain restriction of processing of the data.
- Right to Data Portability: You have the right, in accordance with legal requirements, to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format or to transmit those data to another controller.
- Complaint to Supervisory Authority: Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.
Business Services
We process data of our contractual and business partners, e.g., customers and interested parties (collectively referred to as "contractual partners"), within the scope of contractual and comparable legal relationships, as well as related measures and with regard to communication with contractual partners (or pre-contractually), e.g., to answer inquiries.
We use this data to fulfill our contractual obligations. This includes, in particular, the obligations to provide the agreed services, any updating obligations, and remedies for warranty and other performance disruptions. Furthermore, we use the data to safeguard our rights and for the purposes of administrative tasks associated with these obligations and business organization. In addition, we process the data based on our legitimate interests in proper and economical business management and security measures to protect our contractual partners and our business operations from misuse, endangerment of their data, secrets, information, and rights (e.g., for the involvement of telecommunications, transport, and other auxiliary services as well as subcontractors, banks, tax and legal advisors, payment service providers, or tax authorities). Within the framework of applicable law, we only pass on contractual partners' data to third parties to the extent necessary for the aforementioned purposes or to fulfill legal obligations. Contractual partners will be informed about further forms of processing, e.g., for marketing purposes, within this data protection declaration.
We will inform the contractual partners which data is required for the aforementioned purposes before or during the data collection, e.g., in online forms, by special marking (e.g., colors) or symbols (e.g., asterisks or similar), or personally.
We delete the data after the expiry of legal warranty and comparable obligations, i.e., generally after four years, unless the data is stored in a customer account, e.g., as long as it must be retained for legal archiving reasons (e.g., for tax purposes, generally ten years). Data disclosed to us by the contractual partner within the framework of an order will be deleted by us in accordance with the regulations and generally after the end of the order.

- Online shop, order forms, e-commerce and delivery: We process the data of our customers to enable them to select, purchase, or order the chosen products, goods and related services, as well as their payment and delivery or execution. If necessary for the execution of an order, we use service providers, especially postal, forwarding, and shipping companies, to carry out the delivery or execution for our customers. For the processing of payment transactions, we use the services of banks and payment service providers. The required information is marked as such within the order or comparable acquisition process and includes the information required for delivery, provision and billing, as well as contact information to be able to make any queries; Legal bases: Fulfillment of contract and pre-contractual inquiries (Art. 6 para. 1 lit. b) GDPR).
Provision of the online offering and web hosting
We process user data to be able to provide our online services. For this purpose, we process the user's IP address, which is necessary to transmit the content and functions of our online services to the user's browser or end device.

- Collection of access data and log files: Access to our online offering is logged in the form of so-called "server log files". Server log files may include the address and name of the accessed web pages and files, date and time of access, transferred data volume, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page) and generally IP addresses and the requesting provider. Server log files can be used for security purposes, e.g. to prevent server overload (especially in the case of malicious attacks, so-called DDoS attacks), and to ensure server utilization and stability; Legal bases: Legitimate interests (Art. 6 para. 1 sentence 1 lit. f) GDPR). Deletion of data: Logfile information is stored for a maximum of 30 days and then deleted or anonymized. Use of Cookies
Cookies are small text files or other storage notes that store and read information on end devices. For example, to store the login status in a user account, the contents of a shopping cart in an e-shop, the accessed content, or used functions of an online offering. Cookies can also be used for various purposes, such as for the functionality, security, and convenience of online offerings, and for analyzing visitor flows.
Notes on consent: We use cookies in accordance with legal regulations. Therefore, we obtain prior consent from users, unless it is not required by law. Consent is not necessary, in particular, if the storage and reading of information, including cookies, is absolutely essential to provide users with a telemedia service (i.e. our online offering) explicitly requested by them. The revocable consent is clearly communicated to them and contains information on the respective cookie use.
Notes on data protection legal bases: The data protection legal basis on which we process users' personal data using cookies depends on whether we ask for their consent. If users accept, the legal basis for the use of their data is the given consent. Otherwise, the data utilized by cookies will be processed on the basis of our legitimate interests (e.g., in the economic operation of our online offering and the improvement of its usability) or, if this occurs within the framework of fulfilling our contractual obligations, when the use of cookies is necessary to fulfill our contractual obligations. The purposes for which we use cookies are explained in this privacy policy or within our consent and processing procedures.
Storage duration: With regard to the storage duration, the following types of cookies are distinguished:
- Temporary cookies (also: session cookies): Temporary cookies are deleted at the latest after a user has left an online offering and closed their end device (e.g., browser or mobile application).
- Permanent cookies: Permanent cookies remain stored even after the end device is closed. For example, the login status can be saved and preferred content can be displayed directly when the user revisits a website. Similarly, user data collected using cookies can be used for reach measurement. If we do not provide users with explicit information on the type and storage duration of cookies (e.g., as part of obtaining consent), they should assume that these are permanent and the storage duration can be up to two years.

- Processing of cookie data based on consent: We use a consent management solution to obtain user consent for the use of cookies or for the procedures and providers mentioned within the consent management solution. This procedure serves to obtain, log, manage, and revoke consents, particularly regarding the use of cookies and similar technologies used for storing, reading, and processing information on users' end devices. Within this procedure, user consents for the use of cookies and the associated processing of information, including the specific processing operations and providers mentioned in the consent management procedure, are obtained. Users also have the option to manage and revoke their consents. The consent declarations are stored to avoid repeated inquiries and to be able to prove consent in accordance with legal requirements. Storage is server-side and/or in a cookie (so-called opt-in cookie) or by means of similar technologies to be able to assign the consent to a specific user or their device. If no specific information is available about the providers of consent management services, the following general information applies: The storage duration of the consent is up to two years. When contacting us (e.g., by mail, contact form, email, telephone, or via social media) and within existing user and business relationships, the information of the inquiring persons is processed as far as this is necessary to answer contact inquiries and any requested measures.

- Contact form: When contacting us via our contact form, email or other communication channels, we process the personal data transmitted to us to answer and process the respective request. Newsletter and electronic notifications
We send newsletters, emails, and other electronic notifications (hereinafter "newsletter") exclusively with the consent of the recipients or on the basis of a legal basis. If the contents of a newsletter are specified as part of a subscription, these contents are decisive for the user's consent. For subscribing to our newsletter, providing your email address is usually sufficient. However, to provide you with a personalized service, we may ask for your name for a personal address in the newsletter or for further information, if these are necessary for the purpose of the newsletter.
Deletion and restriction of processing: We may store unsubscribed email addresses for up to three years based on our legitimate interests before deleting them, in order to be able to prove a previously given consent. The processing of this data will be restricted to the purpose of a potential defense against claims. An individual deletion request is possible at any time, provided that the former existence of consent is also confirmed. In the case of obligations for permanent compliance with objections, we reserve the right to store the email address for this purpose alone in a blocking list (so-called "blocklist").
The logging of the registration procedure takes place on the basis of our legitimate interests for the purpose of proving its proper course. Insofar as we commission a service provider with the sending of e-mails, this takes place on the basis of our legitimate interests in an efficient and secure dispatch system.

- Measurement of opening and click rates: The newsletters contain a so-called "web beacon", i.e. a pixel-sized file that is retrieved from our server or its server, if we use a dispatch service provider, when the newsletter is opened. As part of this retrieval, technical information, such as details of the browser and your system, as well as your IP address and the time of retrieval, are initially collected. This information is used for the technical improvement of our newsletter based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined with the help of the IP address) or the access times. This analysis also includes determining whether and when the newsletters are opened and which links are clicked. Promotional communication via e-mail, post, fax or telephone
We process personal data for the purpose of promotional communication, which can take place via various channels, such as e-mail, telephone, post or fax, in accordance with legal requirements.
Recipients have the right to revoke granted consents at any time or to object to promotional communication at any time.
After revocation or objection, we store the data required to prove the previous authorisation to contact or send communications for up to three years after the end of the year of revocation or objection on the basis of our legitimate interests. The processing of this data is limited to the purpose of a possible defence against claims. On the basis of the legitimate interest in permanently observing the users' revocation or objection, we also store the data necessary to prevent renewed contact (e.g. depending on the communication channel, the e-mail address, telephone number, name).

Web analysis, monitoring and optimization
Web analysis (also referred to as "reach measurement") serves to evaluate the visitor flows of our online offering and can include behaviour, interests or demographic information about visitors, such as age or gender, as pseudonymous values. With the help of reach analysis, we can, for example, recognise at what time our online offering or its functions or content are used most frequently, or invite users to reuse them. It also enables us to understand which areas need optimisation.
In addition to web analysis, we may also use testing procedures to test and optimise different versions of our online offering or its components.
Unless stated otherwise below, profiles, i.e., data summarised for a usage process, can be created for these purposes and information can be stored in a browser or on an end device and then read out. The collected information includes, in particular, visited websites and elements used there, as well as technical information, such as the browser used, the computer system used, and information on usage times. If users have consented to the collection of their location data by us or by the providers of the services we use, the processing of location data is also possible.
In addition, users' IP addresses are stored. However, we use an IP masking procedure (i.e. pseudonymisation by shortening the IP address) to protect users. In general, no clear data of users (such as e-mail addresses or names) are stored within the framework of web analysis, A/B testing and optimisation, but pseudonyms. This means that neither we nor the providers of the software used know the actual identity of the users, but only the information stored in their profiles for the purpose of the respective procedures.

We participate in review and rating procedures to evaluate, optimize, and promote our services. If users rate us or provide other feedback via the involved rating platforms or procedures, the general terms and conditions of business or use and the privacy policies of the providers also apply.
